for the rental of event venues by H.R. Siegl GmbH, Schönbrunner Straße 31, 1050 Wien, email: office@filmquartier.at (hereinafter "Filmquartier") towards its clients (hereinafter "Client").
1. Scope
1.1 These General Terms and Conditions apply to all contracts for the short-term rental of premises and the provision of related services between Filmquartier and the Client.
1.2 Individual agreements (e.g., in offers or booking confirmations) take precedence over these Terms.
1.3 Deviating or supplementary terms of the Client only become part of the contract if Filmquartier has expressly agreed to them in writing.
2. Booking and Contract Formation
2.1 Inquiries via the contact form, email or phone are non-binding. A contract is only formed upon written booking confirmation (via email) by Filmquartier.
2.2 Offers by Filmquartier are non-binding unless expressly stated otherwise.
2.3 By receiving the booking confirmation, the Client accepts these Terms.
3. Scope of Services
3.1 Filmquartier provides the Client with the booked premises for the agreed period. The specific scope of services is defined in the respective offer or booking confirmation.
3.2 The basic equipment of the respective venue (furniture, basic technical equipment, WiFi) is included in the rental price unless otherwise stated.
3.3 Additional services (e.g., extended technical equipment, additional furniture, decoration) are agreed upon and charged separately.
4. Prices and Payment
4.1 The prices stated in the respective offer apply. All prices are in euros plus statutory VAT.
4.2 Upon booking confirmation, a deposit of 50% of the total amount is due. The remaining balance must be paid no later than 14 days before the event date.
4.3 Invoices are delivered via email. The invoice amount is due within 14 days of receipt.
4.4 If the booked usage period is exceeded, the additional time is charged proportionally based on the daily rate.
5. Cancellation Policy
5.1 For bookings cancelled outside of the deadlines below, an administration fee of €300 applies.
5.2 From 4 weeks before the event date, a cancellation fee of 50% of the total amount applies.
5.3 From 2 weeks before the event date, the cancellation fee is 100% of the total amount.
5.4 During high season (March 15 – July 15 and September 1 – December 15), deadlines are extended: The 50% cancellation period begins 8 weeks before the event date.
5.5 Cancellations must be made in writing (via email). The date of receipt by Filmquartier is decisive.

6. Use of Premises
6.1 The premises may only be used for the agreed purpose. Subletting or transfer to third parties is not permitted without prior written consent from Filmquartier.
6.2 The contractually agreed maximum number of persons must not be exceeded for fire safety reasons.
6.3 Setup and dismantling must be carried out within the booked time window unless otherwise agreed.
6.4 All events end no later than 11:00 PM. Deviations require prior coordination.
6.5 The Client agrees to be considerate of the neighborhood and avoid excessive noise.
7. Catering
7.1 Filmquartier has a preferred in-house caterer. The use of external catering providers is possible upon prior arrangement.
7.2 Use of the kitchen is only permitted by separate agreement.
8. Damage Liability and Cleaning
8.1 The Client is liable for all damage to the premises, furniture and technical equipment caused by them, their guests, employees or commissioned third parties.
8.2 Damage must be reported to Filmquartier immediately upon discovery.
8.3 Final cleaning is included in the rental price as per the offer. In case of heavy soiling or extraordinary cleaning effort, additional costs will be charged to the Client.
9. Liability of Filmquartier
9.1 Filmquartier is fully liable in cases of intent or gross negligence as well as injury to life, body or health.
9.2 In cases of slight negligence, Filmquartier is only liable for breach of essential contractual obligations, limited to the foreseeable damage typical of the contract.
9.3 Liability for cloakroom items and belongings brought by guests is excluded unless intent or gross negligence applies.
10. Insurance
10.1 The Client is recommended to take out event liability insurance for the booked event.
10.2 Filmquartier holds business liability insurance for the regular use of the premises.
11. Image and Media Rights
11.1 Filmquartier reserves the right to use photos and videos taken during or after events for its own marketing purposes (website, social media, print materials), unless the Client objects in writing before the event.
12. Force Majeure
12.1 If an event cannot take place due to force majeure (e.g., pandemic, official regulations, natural events, war), both parties are entitled to terminate the contract without cancellation fees or to reschedule the event.
13. Confidentiality and Data Protection
13.1 Both parties undertake to treat all confidential information obtained in connection with the contract as strictly confidential. The duty of confidentiality extends beyond the term of the contract.
13.2 Filmquartier processes personal data exclusively in accordance with the GDPR and the Austrian Data Protection Act (DSG). Details on data processing can be found in our Privacy Policy.
14. Final Provisions
14.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
14.3 If the Client is an entrepreneur within the meaning of the KSchG, a legal entity under public law or a public-law special fund, the competent court in 1050 Vienna has jurisdiction for all disputes arising from this contractual relationship.
14.4 Filmquartier is entitled to amend these Terms for objectively justified reasons with reasonable notice. Existing clients will be notified by email no later than two weeks before the changes take effect.

Filmquartier is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
